Marc Anthony Files For Divorce From Jennifer Lopez


Almost nine months after their separation, Marc Anthony has filed for divorce from Jennifer Lopez in Los Angeles Superior Court earlier this week.

The catch-all "irreconcilable differences" box was checked.

Anthony's filing seeks joint legal and physical custody of the couple's twins, Emme and Max, 4, and that the judge dismiss any spousal support for Lopez.

Should she ask for it, that is, which is doubtful. This is likely a formality to make legal a split that has for all intents and purposes been settled already.

The duo married in 2004 and announced their breakup in July, but seem to have kept things amicable, at least when it comes to their reality show, Q'Viva!

Both have had relatively little to say about it publicly, but Anthony spoke out about the split afterward, and according to him, "It wasn't shocking."

It wasn't long before they moved on, either.

Marc has started dating a 24-year-old Venezuelan model Shannon De Lima and Lopez has become inseparable with backup dancer Casper Smart.

NOAA Confirms Unprecedented Warmth in March

The National Oceanic and Atmospheric Administration has released its March 2012 National Overview report, confirming that March was more than just a month of scattered warmth--it shattered records across the U.S., becoming the only month ever recorded, except for January 2006, that had surpassed its record by such a large margin.

According to NOAA, the average temperature across the U.S. was 8.6 degrees above the 20th century average.

However, the report did not just reveal that certain parts of the U.S. had unseasonable warmth; no region was exempt from the weather anomalies.

Every state in the nation experienced at least one record warm daily temperature in March, totaling 15,272 warm temperature records broken.

The Northeast had its warmest March in 118 years this year, averaging 44.4 degrees F, 9.8 degrees above the average for the region.

In the Midwest region, it was the warmest March on record for the region as a whole and individually for each of the nine states within it. Over 6,400 daily temperature records were recorded for the region, 650 of which were records for any day in March.

In the Southeast, Virginia, the Carolinas and northern Georgia and Alabama had monthly temperatures that were 9 to 10 degrees F above average. Birmingham, Ala., Tampa, Fla., Atlanta, Ga., Columbia, S.C., Raleigh-Durham, N.C., and Roanoke, Va., all had their warmest March on record. Additionally, many locations in the Southeast experienced all-time March records for number of days with 80-degree-F temperatures and higher.

The High Plains had many summerlike days throughout March, with widespread monthly temperature departures of 9 to 15 degrees. Average monthly temperature records were broken in each state in the region, some of which had been in place for over 100 years. Many cities broke record high daily temperatures, as well, with some as high as 17 degrees above average.

In the South, mean temperatures for the month ranged from 3 to 15 degrees F above normal. Arkansas, Mississippi, Oklahoma and Tennessee each had their warmest March since records began in 1895.

The West was the coolest region of the U.S. throughout March, but it still experienced some record highs. Long Beach, Calif., hit a record high of 91 F for March 4.

AccuWeather.com's Long-Range Forecasting Team expected the unusual warmth during March and this spring in general.

"At least two-thirds of the nation could wind up with above-normal temperatures (during spring 2012)," AccuWeather.com Paul Pastelok, expert long-range meteorologist and leader of the AccuWeather.com Long-Range Forecasting Team, wrote in a forecast back in late February.

Pastelok said that spring of 2012 would feature the most widespread warmth since 2004.

Literary geeks rejoice! Wolfram Alpha has given you the tools to examine the works of William Shakespeare in ways you've never cared to imagined. Ever wondered how many words are in the second act of Othello? Or what the longest word is in A Midsummer Night's Dream? The answers to such (largely unasked) queries are now mere keystrokes away, and not just for the Bard's writings, either. Chrome Beta update syncs tabs across computers and Android ...

Google has released an update for its Chrome Beta web browser that lets you sync your tabs across multiple computers and devices. The update expands on the tabs feature that was introduced with the Chrome Beta for Android release back in February, which offered a convenient tab-based navigation where you could access tabs you?ve opened on one device from another as long as you are signed in.

With the latest Chrome Beta release you can now do the same across your Mac, Windows, and Linux computers. If you?re signed into your Google account, the tabs you have opened on one computer can be easily accessible on other computers or Android devices. The synced tabs won?t replace the tabs you have open on your current device. They are instead placed in the ?Other devices? menu on the New Tab page.

The back and forward navigation history for the tab is also included, so that you can pick up browsing right where you left off if you have to switch computers or devices. It works with the Chrome Beta for Android allowing you to continue browsing on the go using your mobile phone or tablet without losing your place.

Report says new evidence could tip the balance in aspirin cancer prevention care

A new report by American Cancer Society scientists says new data showing aspirin's potential role in reducing the risk of cancer death bring us considerably closer to the time when cancer prevention can be included in clinical guidelines for the use of aspirin in preventative care. The report, published early online in Nature Reviews Clinical Oncology, says even a 10% reduction in overall cancer incidence beginning during the first 10 years of treatment could tip the balance of benefits and risks favorably in average-risk populations.

Current guidelines for the use of aspirin in disease prevention consider only its cardiovascular benefits, weighed against the potential harm from aspirin-induced bleeding. While daily aspirin use has also been convincingly shown to reduce the risk of colorectal cancer and recurrence of adenomatous polyps, these benefits alone do not outweigh harms from aspirin-induced bleeding in average-risk populations. But recently published secondary analyses of cardiovascular trials have provided the first randomized evidence that daily aspirin use may also reduce the incidence of all cancers combined, even at low doses (75-100 mg daily).

The current review, led by Michael J. Thun, M.D., vice president emeritus of epidemiology and surveillance research for the American Cancer Society was not designed as a comprehensive review of the literature, but instead is a focused discussion of the key outstanding issues in using aspirin as a cancer prevention tool.

The report says recently published meta-analyses of results from randomized trials of daily aspirin treatment to prevent vascular events have provided provocative evidence that daily aspirin at doses of 75 mg and above might lower both overall cancer incidence and overall cancer mortality.

In six primary prevention trials of daily low-dose aspirin, randomization to aspirin treatment was associated with an approximately 20% reduction in overall cancer incidence between 3 and 5 years after initiation of the intervention (metaodds ratio [OR] = 0.81; 95% CI 0.67-0.98) and a 30% reduction during follow up more than 5 years after randomization (meta-OR = 0.70; 95% CI 0.56-0.88). Cancer mortality was also reduced during study follow up that happened more than 5 years after the start of aspirin use (meta-OR = 0.63; 95% CI 0.49-0.82) in analyses that included 34 trials of daily aspirin at various doses. Surprisingly, the size of the observed benefit did not increase with daily doses of aspirin above 75-100 mg. Notably, these meta-analyses excluded results from the Women's Health Study (WHS), a large 10-year-long trial of 100 mg of aspirin taken every other day, which reported no reduction in cancer incidence or mortality.

"The accumulating data from randomized clinical trials provide an exciting opportunity to reconsider the potential role of aspirin in cancer prevention," write the authors. They say several important questions remain unanswered, such as the exact magnitude of the overall cancer benefit and which individual cancer sites contribute to this benefit. "However, these new data bring us considerably closer to the time when cancer prevention can be integrated into the clinical guidelines for prophylactic treatment following regulatory review by the FDA and the European Medicines Agency."

Dow Jones Says Q1 2012 U.S. Venture Fundraising Up 5 Percent, NVCA Reports 35 Percent Decrease

dow jonesThanks to big raises from venture firms like Andreessen Horowitz, U.S. venture capital fund-raising increased to $7 billion across 47 funds in the first quarter of 2012, which is a 5% increase in capital raised and a 34% increase in fund closings from the same period last year according to Dow Jones. The report says that 23 early-stage funds raised $1.6 billion, which is a 35% increase in fund closings and nearly triple the amount of capital raised during the first quarter of last year. Dow Jones says that just three early-stage funds accounted for 79% of the total, and 12 funds targeting $50 million or less in fundraising held final closings during the first quarter.

Army reservist says bank left him with $25,000 in charges

John McDevitt, a U.S. Army reservist from Clayville, N.Y., said Bank of America and Visa have not helped him re-coup $25,243.71 in fraudulent charges accrued on his debit card almost two years ago while he was on leave from service.

McDevitt, 52, of Clayville, N.Y., was not aware of these differences while served in Afghanistan for a year. He spent his two free weeks in Greece in November 2010 according to a policy afforded to soldiers deployed in a combat zone.

"My kids are grown," he said of his children ages 29 and 27. "I'm in my 50s. I always wanted to go to Athens, Greece because I'm a big history buff."

While in Athens and by himself, McDevitt said he asked a taxi driver to take him to a nightclub without a specific destination.

"I told the taxi driver I want to go to a night club ? not a strip club," he said.

He said the driver brought him to a club at around 10 p.m. but he "didn't like the environment." He said he ordered two beers.

"I'm not really a drinker. I'm just a beer drinker," he said.

He said he was at a club called Palia Plaka for about an hour and a half.

McDevitt said he only talked to the waiter while he sat at a small table, though "a couple girls tried to come over."

"I already know what that's about," he told ABC News. "I said, 'Nope.'"

When he tried to pay with his Bank of America debit card and leave the club, he said workers claimed he owed them more money. Instead of arguing with them, he said he paid the inflated sum of 600 euros, signed a receipt for his drinks and left.

"I'm in Athens, Greece. I don't want to go to jail," he said. "You sign, you leave. You just want to get out of there."

Two weeks later at his base in Afghanistan, he said he checked his account online and saw six charges totaling $25,243.71. The charges were between $2,058.66 and $6,780.66 for Nov. 12, Nov. 19 and Nov. 22, 2010.

Outraged over the charges he said Bank of America should refund him, McDevitt protested outside a branch in Utica, N.Y. last week, holding a sign that read, "A soldier that puts America first should have a bank that puts the soldier first,"as reported by WKTV.

On Nov. 29, 2010, McDevitt notified Bank of America, which issued a temporary credit to his account for the full amount on Dec. 3, 2010, while the fraud claim was being reported. But the bank took back the funds after determining that "no error had occurred in this instance" as stated in a letter sent Dec. 9. 2010 from the bank.

McDevitt said his only option was to use a debit card because he has been unable to obtain a credit card after his ex-wife filed for bankruptcy.

"I paid off all my credit, but I still can't get a credit card," he said. Now an auditor with New York State, he also wanted to use his money to help pay for his daughter's wedding in June.

"Right now, my parents are helping me out because they know my situation," he said. "I tried to get a loan but because of my past credit, that's denied."

In a letter provided to ABC News by McDevitt, the bank said that on Dec. 9, 2010, it "received the signed sales drafts from the merchant reflecting your signature and card imprint."

Attempts by ABC News to reach the club for comment were unsuccessful.

"We found that the transaction activity in question was authorized and posted, or billed, correctly to your account," the letter stated.

The bank also stated that it attempted a "chargeback" against the merchant but on Feb. 23, 2011, "the merchant represented the transactions stating that they were valid, based on the sales drafts already provided."

The bank also wrote in that letter, "due to your initial interaction with the merchant, this case is considered a non-fraud claim. Furthermor, you were unable to provide copies of the receipts for the initial transactions that you said you authorized."

McDevitt said the signatures on the receipts are not his and there is no record of the receipt he actually signed.

T.J. Crawford, spokesman for Bank of America, said the bank cannot discuss McDevitt's account, citing customer privacy concerns.

"With any fraud claim, there is a very thorough review process we go through to verify its authenticity," he said.

When asked whether a customer's proof that a signature does not match his is evidence of a lack of authenticity, Crawford said "every instance is unique."

"These are handled on a case-by-case basis," Crawford said.

In a letter dated May 13, 2011 from the bank provided by McDevitt, the bank said "Our attempts to resolve this matter with the merchant have been unsuccessful. We have exhausted all our available options. We can only suggest that you explore other avenues of recourse to obtain a refund and/or come to a more equitable solution with the merchant."

The bank, which followed the rules of fraud protection and also took measures in "good faith," stated that Visa "advised us that they have declined our arbitration case and have decided in favor of the merchant" on May 13, 2011.

A spokesman for Visa said the company is looking into the matter before it can comment.

Consumers should be aware of differences in fraud protection for credit cards and debit cards, Beverly Harzog, credit card expert with Credit.com, said. With credit cards, the maximum liability for fraudulent charges is $50. If you report the loss or theft of your card before it's used, you're not liable for anything. In most cases, the $50 is also waived

"The rules for debit cards are different," she said. Harzog said if your debit card is lost or stolen, you have to report this within two business days to limit your liability to $50. If you don't report it within two days, you can be liable for $500. But if you don't report an unauthorized transfer within 60 days of receiving the statement showing the fraudulent transfer of money, your losses can be unlimited.

"If there are unauthorized charges on your debit card statement and you haven't lost the card or it hasn't been stolen, you have to report the fraudulent charges within 60 days of the date on the statement to limit your liability," Harzog said. "You're only liable for charges after that 60-day window if you fail to report it."

McDevitt filed a claim with Bank of America within two weeks of his visit to Greece, but the bank found the charges were not fraudulent.

Harzog said she suggested that McDevitt contact the Consumer Financial Protection Bureau.

"Whether or not the bureau can help him isn't clear, but I think it's a step he should take," she said. "It's been a year and a half since this started and he's going to need someone to help him get through the bureaucracy to find out if he can get his money back."

McDevitt said he has spoken to a lawyer and tried to get in contact with the merchant without success. He said he also got in touch with the New York State Attorney General's office.

"Every time I get deeper and deeper, I'm told 'no,'" he said, though he has not yet tried to get in touch with Visa.

"I was robbed of money," he said. "I just think the law should be changed, whether it's debit or credit."

(AP) ? When Burger King set about to fix its ailing empire, the fast food giant started by scrutinizing everything on the menu ? even the mayonnaise.

A group of Burger King executives and franchisees last year sat through a lengthy presentation complete with charts and graphs on how oils and eggs affect the quality of the spread. A blind taste test of 30 varieties followed. The verdict: They liked the one Burger King was already using.

"That was actually a pretty hard day," recalls John Koch, Burger King's executive chef.

It wasn't the only one. Over the past year, Burger King evaluated all of its ingredients from the bacon to the cheese slices it serves on its chargrilled burgers as part of a yearlong quest to reverse years of slumping sales of its Whoppers and fries. The result: On Monday, it plans to launch a lineup of smoothies, frappe coffees, chicken strips and snack wraps. The 10 new items mark Burger King's biggest menu expansion since the chain opened its doors in 1954.

Burger King's food odyssey shows how grueling it can be for a fast-food company to come up with new menu items ? a process most Americans aren't aware of when they're handed a bag at a drive-thru window. Burger King is the latest chain to revamp its menu as part of the fast-food industry's move away from its nearly single-minded courtship of young men. Once the lifeblood of the industry, the economic downturn hit those junk food fanatics particularly hard. At the same time, Americans' generally have been demanding healthier options.

Burger King has failed to evolve even as competitors have gone after new customers with breakfast items and healthier fare. Last year, Wendy's for the first time edged out Burger King as the nation's No. 2 burger chain behind McDonald's. To stem the decline, Burger King executives last year decided to remodel its aging system of 7,200 stores to make them more contemporary, redesign worker uniforms with aprons so they stay clean and even serve the iconic Whopper in cardboard cartons instead of paper burger wrapping for the first time in more than 20 years. The food, however, is at the heart of its plan.

Consumers have longed for more food options at Burger King, but the revamp is a gamble. The new menu may not go far enough to differentiate Burger King from its competitors.

After all, there are striking similarities between Burger King's new items and the offerings of its much-bigger rival McDonald's. The Golden Arches already rolled out specialty salads in 2003, snack wraps in 2006, premium coffee drinks in 2009, and fruit smoothies in 2010.

"Being an innovator is critical in the fast-food industry," said Darren Tristano, an analyst for food industry researcher Technomic Inc. But in recent years, he said Burger King has been more of a follower.

Burger King executives don't deny that its new items are pretty close to those on McDonald's popular menu. But they say the new menu was created as a result of Burger King's own research.

"Consumers wanted more choices," said Steve Wiborg, president of Burger King's North America operations. "Not just healthy choices, but choices they could get at the competition."

THE RAMP UP

The fast-food industry has undergone a shift in recent years. Just five years ago, the top three fast-food companies were all burger chains. But concerns over obesity have paved the way for competitors like Subway, now the second-biggest chain, and Starbucks, which climbed up the rankings to the No. 3 spot. Smaller players such as Five Guys, which sells made-to-order burgers, are gaining ground too.

McDonald's quickly adapted. The world's biggest burger chain reinvented itself as a hip, healthier place to eat by offering wireless Internet and rolling out a string of hit menu items such as fruit smoothies, iced coffees and oatmeal.

Burger King failed to keep up. Its share of sales among burger chains fell from 17 percent a decade ago to 12 percent last year, according to researcher Technomic. McDonald's share rose from 42 percent to 50 percent.

All Tom McDonald had to do was look at Burger King's competitors to see why sales at the chain were falling. A Burger King franchisee since 1989, McDonald said the chain's menu hadn't changed much over the years.

"We were getting behind with the wraps and salads that were coming on the market," said McDonald, who owns 19 franchises. "We had salads, but they weren't as good as the competition. We focused on burgers maybe longer than we should have."

McDonald said he expressed his concerns at the company's failure to keep up with the times. But the Miami-based chain had gone through a series of owners over the years, and McDonald said he got little response from corporate about addressing the problems.

He said the attitude from the top changed, however, after New York-based private equity firm 3G Capital bought Burger King last year. That's when Burger King assembled a group of 15 key executives, franchisees and suppliers to evaluate the chain's menu, item by item.

The process, which took three months of daylong meetings, was grueling at times. French fries took multiple days, given the various factors like seasoning, oil and frying method. Even the day for soft-serve ice cream, which was rolled out last summer, wasn't as fun as it might sound: A supplier that had 400 vanilla flavors presented the nuances between Madagascar and honey vanilla.

"Trying to come up with the exact intensity of vanilla you need is a little bit daunting," said Koch, Burger King's chef.

Burger King quietly put some changes in place over the past year. The French fries are thicker so they'll stay hot longer. Burgers now come with one slice of cheese instead of two, so it melts more evenly. And naturally-smoked bacon is now cooked at each restaurant. Previously, Burger King had used a pre-cooked variety with a smoked flavor sprayed on.

THE ROLLOUT

Once executives settled on menu items, it was time to go to the masses. Would the new items measure up to those of Burger King's competitors? To find out, the company conducted consumer tests and revised its recipes over months.

Burger King considered making Panini-pressed snack wraps, for example, but tests showed customers wanted something lighter. The wraps it settled on closely resemble the ones offered at McDonald's ? a chicken strip sprinkled with cheese, lettuce and dressing wrapped in a flour tortilla. McDonald's even offers the same flavors ? honey mustard and ranch.

Even seemingly straightforward items had to be reworked over and over. The new "Homestyle Chicken Strips" went through 11 variations before the final version was selected. And it took about seven months and six tries before the company found the right mix of creaminess, iciness and tanginess for its strawberry banana and tropical mango smoothies.

"They didn't rush these products out to market," said McDonald, the Burger King franchisee who regularly eats at competitors to stay on top of what they're doing. He said he's confident the new menu items stack up to rivals. "They got feedback from consumers and reformulated them to get it right."

But food isn't Burger King's only problem. Many of its restaurants are showing signs of aging. So the company decided it wanted to give them a more modern look that mixes leather armchairs, high stools and plastic chairs in warmer lighting. High partitions will create more privacy in some seating areas. The makeover costs an average of more than $275,000 per restaurant.

That presents another challenge: getting buy-in from franchisees, who own 90 percent of the chain's U.S. stores. So the company is offering those who sign up for the remodeling incentives, such as a 50 percent discount on the annual $50,000 franchise fee.

So far, more than 1,000 franchise locations are slated to be updated in the next year. Over the next three years, 2,500 will be remodeled.

Customers will see changes even in stores that aren't remodeled. The drab red, black or blue shirts workers used to wear have been replaced by metal gray shirts and aprons that were designed with the help of employees. Wrappers, cups and bags now have vivid photos of food that were shot by the same photographer responsible for the catalogs of the high-end housewares retailer Williams-Sonoma.

To get the word out about the changes, Burger King is rolling out its biggest marketing campaign ever. TV ads will feature celebrities, including soccer player David Beckham, comedian Jay Leno and actress Salma Hayek. In one spot, R&B singer Mary J. Blige croons the ingredients of the snack wraps.

Whether the star power of the ads, updated stores and the new food on the menu can fix Burger King's troubles remains to be seen. But Alex Macedo, chief marketing officer for Burger King North America, said the chain has a good chance of rebounding because Burger King is a brand everyone knows.

"People love Burger King and really want a reason to come back," he said.
